2. Grounds for Conducting Enhanced Due Diligence

The Service has the right to initiate an enhanced AML check, as well as to request from the User information on the source of funds, completion of the KYC procedure (identity verification), and other necessary information in cases where the sender’s address or the transaction is associated with the following risk sources:

3. High-Risk Criteria

Enhanced due diligence is also applied in cases where:

  • the overall AML risk score for the transaction exceeds 60%;

  • a high level of risk is identified for one or more sources specified in Section 2 of this Policy.

4. Measures Applied When Increased Risk Is Identified

When an increased or high level of risk is identified, the Service reserves the right to:

4.1. Suspend the exchange operation until the completion of the verification.

4.2. Hold the User’s digital assets until the incident investigation is fully completed.

4.3. Request a photo or video recording of a document confirming the User’s identity.

4.4. Request a screenshot or video recording of the personal wallet used for withdrawing cryptocurrency.

4.5. Request other materials and documents from the User related to the specific exchange operation.

5. Transfer of Information to Third Parties

The Service has the right to transfer information provided by the User to third parties exclusively in the following cases:

  • upon an official request from law enforcement authorities;

  • by court decisions of various instances;

  • upon requests from payment systеm administrations and financial regulators.

6. Procedure for the Return of Digital Assets

6.1. The return of digital assets is carried out exclusively to the details from which the original transfer was made.

6.2. A return is possible only upon confirmation of the legal origin of the funds.

6.3. The returned amount is transferred minus the network fee of the respective cryptocurrency.

6.4. The return is carried out only after the User has successfully completed the identification procedure (if required), as well as after the incident has been reviewed by the regulator and permission for the return has been obtained (if required).

6.5. The return of digital assets shall be completed within 72 hours from the moment the User provides valid refund details and fulfills all necessary conditions stipulated in this section, during business days.

7. Stages and Estimated Timeframes of AML Verification

AML verification of transactions and cryptocurrency addresses within the operation of the Service is carried out in several stages.

7.1. Automatic Verification and Risk Score Assessment

After a transaction is received, the systеm performs an automatic analysis of the cryptocurrency address and/or transaction using specialized AML services. Based on the analysis results, the transaction risk level is determined, including possible links to sanctioned addresses, mixers, darknet platforms, fraudulent schemes, or hacks.
Estimated processing time: from a few seconds to 1 business day.

7.2. Decision Making

  • confirmation of the transaction and completion of the exchange;

  • temporary suspension of the transaction until additional information is received from the User;

  • refusal to carry out the exchange in accordance with the requirements of the Service’s AML Policy, with a request sent to the User to undergo the identity verification (KYC) procedure and/or to provide additional data and documents;

  • refusal to carry out the exchange and a refund of funds without requesting additional data, if the information provided is sufficient to make a decision.

8. Limitation of Liability

The service cryptolavka.com, its administration, employees, and domain owners are not responsible for unlawful actions of third parties, actions of malicious actors, as well as for possible damage arising from the use of the Service.

9. Warning on Prohibited Use of the Service

The Service warns Users against attempts to use cryptolavka.com for the legalization of funds obtained through criminal means, terrorist financing, as well as for the purchase of prohibited goods and services.

10. Final Provisions

The Service does not bear legal responsibility for its use for illegal purposes; however, it undertakes to take all possible and available measures to prevent attempts to use cryptolavka.com for the legalization of funds obtained through criminal means, terrorist financing, or the purchase of prohibited goods and services.

By performing an exchange, the User confirms that they have read the terms of this AML Policy, accept them in full, and undertake to comply with them.
